Armando Personal Injury Law Warns Tampa Drivers About Insurance and Liability Issues in Amazon Flex Accidents

As Amazon continues expanding its delivery footprint in Florida and across the country, Armando Personal Injury Law is warning Tampa Bay drivers, passengers, pedestrians, and families that crashes involving Amazon Flex drivers can raise complicated insurance and liability issues that do not exist in an ordinary car accident case. Amazon describes Flex drivers as independent contractors who use their own vehicles to deliver packages, and Amazon says its commercial auto policy applies only when the delivery partner is actively delivering during a delivery block.
That distinction can matter immediately after a wreck. Amazon’s public FAQ says Flex drivers in most states outside New York are provided commercial auto insurance that includes auto liability coverage, uninsured or underinsured motorist coverage, and contingent comprehensive and collision coverage. But Amazon also says that coverage applies only while the driver is actively delivering during the delivery block, which means app status, route timing, package scans, and who was actually driving can become critical issues in a serious injury claim.
Those questions may become even more important as Amazon expands faster delivery service. In 2025, Amazon announced plans to expand Same-Day and Next-Day delivery to more than 4,000 smaller cities, towns, and rural communities by the end of the year, said it was investing more than $4 billion to triple the size of its delivery network by 2026, and said those new facilities would create more driving opportunities through programs including Amazon Flex. Amazon also announced in March 2026 that its grocery-delivery collaboration with Winn-Dixie expanded into the Greater Tampa Bay area.
“People injured by a delivery driver should not assume the insurance picture is simple just because the driver was working for a major platform,” said Attorney Armando Edmiston, founding attorney of Armando Personal Injury Law. “In an Amazon Flex case, the claim may turn on whether the driver was in an active block, what the app and route data show, what policy was triggered, and whether key digital evidence is preserved early. Those are not small details. They can shape the entire case.”
Armando Personal Injury Law says these cases may require immediate investigation into delivery-block records, pickup and drop-off timing, app screenshots, phone-location data, crash reports, witness statements, vehicle damage, and all available insurance policies. The firm’s existing Tampa Amazon Flex accident page explains that the central issue in many of these cases is whether the driver was actively delivering at the moment of impact, because that may affect whether Amazon-related commercial coverage is available or whether a personal policy dispute becomes part of the case.
In Florida, injured people may also be dealing with the state’s no-fault system and comparative-fault rules while trying to sort out Amazon-related coverage questions. Florida’s personal injury protection statute generally requires initial services and care within 14 days after a motor vehicle accident, and Florida’s comparative fault statute says a party found more than 50 percent at fault in a negligence action may not recover damages.
“Delivery crashes can happen on neighborhood streets, in apartment complexes, near retail centers, and on major Tampa Bay roads,” Edmiston said. “When someone is hurt, the focus should be on protecting evidence, identifying every available source of coverage, and understanding what legal options may exist before insurers start narrowing the story.”
